14.2 Binding Arbitration

EXCEPT AS OTHERWISE PROVIDED HEREIN, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR TO THE USE OF OUR SERVICES, SHALL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION ("AAA") OR SUCH OTHER MUTUALLY AGREED ARBITRATION BODY.

The arbitration shall be conducted in accordance with the AAA's Consumer Arbitration Rules, as amended from time to time, which are available at www.adr.org. The arbitrator shall apply applicable substantive law consistent with the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and applicable statutes of limitations.

14.3 Class Action Waiver

YOU AND STARBIRD CHICKEN EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND STARBIRD CHICKEN EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT SUCH PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Nothing in this section shall prevent either party from seeking emergency relief in appropriate circumstances.

In the event of a Force Majeure Event, we will notify you as soon as reasonably practicable, and our obligations under these Terms shall be suspended for the duration of the Force Majeure Event.

18. Severability
